Welcome to Spedim. Please read these Terms and Conditions ("Terms") carefully before using our mobile application or services. By accessing or using Spedim, you agree to be bound by these Terms. If you do not agree with any part of these Terms, do not access or use the platform.

1. Definitions

  • Spedim: Refers to the mobile application and digital platform offering ride-hailing and food delivery services.
  • User: Any individual who registers for, accesses, or uses the Spedim platform.
  • Driver: An independent service provider registered on Spedim to offer ride-hailing services.
  • Courier: An individual registered to deliver food via Spedim.
  • Restaurant Partner: A third-party business offering food items via the Spedim platform.
  • Service: Collectively refers to all services provided through the Spedim app, including ride-hailing and food delivery.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use Spedim. By using the app, you represent and warrant that you meet these requirements.

3. User Accounts

  • To use Spedim, you must create an account with accurate and complete personal information.
  • You are responsible for maintaining the confidentiality of your account and password.
  • You agree to notify Spedim immediately of any unauthorized use of your account.
  • Spedim is not liable for any loss or damage arising from your failure to safeguard your account credentials.

4. Services

4.1 Ride-Hailing

  • Spedim connects Users with Drivers for personal transportation services.
  • The service is on-demand or scheduled, depending on availability.
  • Spedim does not operate vehicles nor employ drivers — all Drivers are independent contractors.

4.2 Food Delivery

  • Users may browse menus and place orders from listed Restaurant Partners.
  • Spedim facilitates the order and assigns a Courier to pick up and deliver the food.
  • Spedim is not responsible for the quality or preparation of the food items.

5. Pricing and Payments

  • Prices for rides and food orders are clearly displayed before confirmation.
  • Prices may include service fees, delivery fees, surge pricing, or taxes.
  • Payment must be made via the available in-app payment methods (e.g., credit/debit card, mobile money, or cash where applicable).
  • All transactions are final unless a refund is approved under specific conditions (see Section 6).

6. Refund and Cancellation Policy

  • Rides: You may cancel a ride request, but cancellation fees may apply if the Driver has already been dispatched.
  • Food Orders: Orders cannot be canceled once they are confirmed by the restaurant. Refunds are only issued for:
    • Undelivered items
    • Incorrect or severely damaged items
    • Non-availability from the restaurant or courier
  • Refund requests must be submitted within 24 hours via the support section of the app.

7. Ratings and Reviews

  • Users can rate and review Drivers, Couriers, and Restaurant Partners.
  • All reviews must be honest, respectful, and relevant.
  • Spedim reserves the right to moderate or remove reviews that violate our community standards.

8. User Conduct

You agree not to:

  • Use the platform for unlawful or harmful purposes.
  • Abuse, threaten, or harass Drivers, Couriers, restaurant staff, or other users.
  • Attempt to manipulate prices or service availability.
  • Interfere with the system integrity or functionality of the app.

Violation of these conditions may result in suspension or permanent deactivation of your account.

9. Driver and Courier Obligations

Drivers and Couriers must:

  • Maintain a valid driver’s license and any required permits.
  • Use safe, well-maintained vehicles or motorcycles.
  • Respect customers, follow traffic laws, and deliver services professionally.
  • Not discriminate based on race, gender, religion, or other personal characteristics.

10. Restaurant Partner Responsibilities

  • Restaurants must ensure the accuracy of their menu, pricing, and availability.
  • Food must be prepared hygienically and packed securely.
  • Restaurants are fully responsible for the quality and safety of their food.

11. Intellectual Property

All content on the Spedim platform — including logos, graphics, software, and text — is the property of Spedim or its licensors. You may not use, reproduce, or distribute any content without prior written permission.

12. Limitation of Liability

Spedim provides its platform "as is" and "as available." We do not guarantee that the service will be uninterrupted or error-free.

To the maximum extent permitted by law, Spedim is not liable for:

  • Personal injury or property damage resulting from use of the service
  • Unauthorized access to your data
  • Actions or omissions of Drivers, Couriers, or Restaurant Partners

13. Indemnification

You agree to indemnify and hold Spedim, its affiliates, and partners harmless from any claims, losses, liabilities, and expenses arising from your use of the service or breach of these Terms.

14. Termination

Spedim reserves the right to suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent or harmful behavior
  • It is required by law or legal order

15. Modifications to Terms

We may update these Terms from time to time. Continued use of Spedim after changes are published means you accept the updated Terms. You are responsible for reviewing the Terms periodically.

16. Governing Law

These Terms are governed by and construed in accordance with the laws applicable in your jurisdiction. Any disputes shall be resolved in accordance with local legal procedures.
